Any such prohibited use will immediately and automatically terminate your license to use the Software and Services, without prejudice to any other remedies available to us at law or in equity. Prohibited Conduct As a user of TRIPLE APE VPN, you hereby commit to abstain from engaging in the following activities while utilizing our services: 1. Employing our service for any form of criminal activity, including but not limited to identity theft, hacking, or fraud. 2. Transmitting viruses, worms, trojans, spyware, or malware through our service. 3. Sharing copyrighted files without obtaining proper authorization. 4. Harassing, blackmailing, or threatening others. 5. Utilizing our service to initiate Distributed Denial of Service (DDoS) attacks on individuals, websites, computers, or networks. 6. Attacking, hacking, or conducting scans on other computers or networks through our service. 7. Sending unsolicited data in any form, such as email SPAM, hate mail, mass marketing emails, unsolicited SMS and IM messages, etc. 8. Downloading, uploading, or distributing child pornography. 9. Attacking our resources or servers. 10. Employing our service for phishing purposes. 11. Utilizing our service for acts related to terrorism. 12. Using a credit card that does not belong to you to make payments for our service.

Proprietary Rights

The Software, Site, and Features, including any versions, patches, fixes, modifications, enhancements, and/or updates, along with related materials and services, are owned by us or our licensors and are protected by intellectual property laws, including copyright laws and treaties. You acknowledge that all rights, titles, and interests in and to the Software, the Site, and features, as well as related intellectual property rights (including, without limitation, any patents, whether registered or pending, copyrights, trade secrets, designs, or trademarks) endorsed, embodied, affixed, linked to, or associated with the Software, the Site, and features, are and will remain the sole property of us or our licensors. Limitation of Liability

Indemnification

You hereby agree to indemnify, defend, and hold us, our subsidiaries, parent corporation, and affiliates, partners, sponsors, and all of their respective officers, directors, owners, employees, agents, attorneys, licensors, representatives, licensees, and suppliers (collectively, “Parties”), harmless from and against any and all liabilities, losses, expenses, damages, and costs (including reasonable attorneys’ fees) incurred by any of the Parties in connection with any claim arising out of your use of the Site or Services, any use or alleged use of your account or your password by any person, whether or not authorized by you, your violation or breach of this Agreement, or your violation of the rights of any other person or entity. Termination This Agreement shall be deemed effective upon the earlier of your access to the Services or installation of the Software and shall remain in force until terminated by either party (the "Term"). You have the right to terminate your association with us at any time by completely uninstalling the Software. Failure to adhere to the terms and conditions of this Agreement or any other agreements with us will result in the termination of your license and this Agreement. Upon termination of this Agreement, the granted license shall automatically expire, and you are required to cease all further use of the Software and Services. We reserve the right to take any of the following actions at our sole discretion, without prior notice to you: Restrict, deactivate, suspend, or terminate your access to the Services, including the deletion of your accounts and all related information and files within your account. Refuse, relocate, or remove any material available on or through the Services. Establish additional general practices and limits regarding the use of the Services. We reserve the right to take any of the aforementioned actions for any reason, at our sole discretion. This includes, but is not limited to, (a) your breach or violation of this Agreement, (b) requests by law enforcement authorities or other governmental agencies, (c) a request by you, (d) discontinuance or material modification to the Services (or any part thereof), and (e) unexpected technical or security issues or problems. Compliance with Law & Export Control The Software is intended for use only in compliance with applicable laws, and you undertake to use it in accordance with all such laws. Without prejudice to the foregoing and any other terms herein, you agree to comply with all applicable export laws, restrictions, and regulations.
